A Federal Lawsuit Has Been Filed In The Case Of A Man Who Passed Away At An Indiana Jail After 20 Days In Solitary Confinement

Joshua McLemore was held in solitary confinement at the Jackson County Jail for about three weeks.

After being hauled to the jail on July 20, 2021, he hardly drank or ate. He urinated and poop on the ground. He shed 45 lbs.

When the correctional personnel requested medical assistance, McLemore’s organs were already failing. On August 10, 2021, he passed away at a hospital in Cincinnati at the age of 29.

The cause of death was determined by an autopsy to be “multiple organ failure due to refusal to eat or drink with altered mental status due to untreated schizophrenia.”

According to an inquiry by the Indiana State Police, jail officials neglected McLemore, and the Jackson County Prosecutor’s Office concurred. However, no crimes were filed as a result of this neglect.

The estate of McLemore filed a federal complaint this week seeking punitive damages, attorneys’ costs, and other appropriate relief, as well as monetary damages for mental, bodily, and emotional distress.

It identifies the following people as defendants: Advanced Correctional Healthcare, Inc., a private company that provides healthcare services at correctional facilities in 21 states; Jackson County Sheriff Rick Meyer; Jail Commander Chris Everhart; jail staff.

Josh McLemore was not an offender. He had a crisis and was psychologically unwell. Hank Balson, an attorney for McLemore’s estate, claimed that McLemore was out of touch with reality and in need of assistance.

Anyone who views the videos of him in his isolation cell will immediately recognize this. Josh sat naked in his cell for almost three weeks, hardly slept or ate, and the Jackson County sheriff and his staff did not provide him with the care he so desperately needed.

Instead, they watched as Josh withered away in their presence. Not only is this against the law, but it is also immoral.
